Jinayah is a criminal act or criminal action that includes crime on the soul or on objects. In this discussion, Mushanif discusses punishment on the soul, be it murder or maltreatment.
There are three kinds of murder:
1. 'Amdun Mahdh (purely intentional)
2. Khatha Mahdh (purely mistaken)
3. ‘Amdun Khatha (intentional but mistaken)
Murderer 'amdun mahdh is someone deliberately hitting the victim with something that is generally used to kill and really intends (by hitting it) to kill. Then (as a result of this murder) it is obligatory for the killer to be punished with kisas if (the victim's heirs) pardon the killer then it must be paid in a heavy diyat3 taken from the killer's property.
