Federal Law No. 8.906, of July 4, 1994, provides for the Statute of Advocacy and the Brazilian Bar Association (OAB)
According to art. 1 of this Law, the application to the Judiciary is a private law activity, with the exception of the habeas corpus filing, which is the only non-private procedural document of a lawyer, which can be filed by anyone, including the prisoner or the Judge or Prosecutor of Justice ex-officio, whenever there is an illegal imprisonment or an excess of time for investigating the guilt (or intent) of the accused.
