Established in 1962, the 13th salary represents a relief in the domestic budget for Brazilian employees and, therefore, is the most awaited salary.
Due to employees with a formal contract, retirees, pensioners and civil servants, the benefit, also known as Christmas bonus, must be paid by the employer in two installments: the first between February 1st and November 30th; and the second until December 20th.
CALCULATION OF THE 13TH SALARY
The 13th salary is calculated by dividing the full salary by 12 and multiplying the result by the number of months worked. Other installments of a salary nature, such as overtime, additional (night, unhealthy and hazardous work) and commissions are also included in this calculation.
10 THINGS YOU NEED TO KNOW ABOUT THE THIRTEENTH
1 ️⃣ The first installment of the 13th salary can be received on vacation. In this case, the employee must request the advance in writing from the employer by January of the respective year.
2 ️⃣ The 13th salary can be paid on the occasion of the termination of the work contract, whether by the end of the contract, when signed for a determined period, by resignation or by waiver, even occurring before the month of December.
3 ️⃣ The employee dismissed for just cause is not entitled to the 13th salary.
4 ️⃣ From 15 days of service, the employee is already entitled to receive the 13th salary.
5 ️⃣ INSS retirees and pensioners also receive the gratification.
6 ️⃣ The employee who has more than 15 unexcused absences in the month may have deducted from his 13th salary the fraction of 1/12 for the period.
7 ️⃣ The basis for calculating the 13th salary is the gross salary, without deductions or advances, due in December of the current year or, in the case of dismissal, the month of the contract termination agreement.
8 ️⃣ If the deadline for payment of the 13th salary falls on Sunday or holiday, the employer must anticipate it. If you don't, you are subject to a fine.
9 ️⃣ The employer will also be subject to a fine if he pays the 13th salary in just one installment.
🔟 The employer is under no obligation to pay all employees in the same month, but needs to respect the legal deadline for the payment of the 13th salary, that is, between February and November.
