STUCK provides an online platform whereby users can connect with vendors who offer roadside assistance and tow services (hereafter, “Providers” or “Third Party Services”). STUCK offers a method of scheduling service through third party Providers but does not, and does not intend to, provide Third Party Services or act in any way as a Third Party Service Provider, and has no responsibility or liability for any Third Party Service Provider or services failed to be provided. STUCK has no control over the quality, safety, or legality of any aspect of Providers’ services or offerings or any claims made by Providers about the services they offer. Providers are not employees or contractors of STUCK but rather of Third-Party Service Providers, and STUCK is not responsible for their actions or inactions.
Utilizing services with STUCK is subject to the following additional terms and conditions:
By using the STUCK Services, you represent and warrant that all registration information you submit, including, without limitation, your first and last name, mobile telephone number, vehicle information (make, model, year, etc.), and credit card or financial account payment information is completely accurate and truthful. You also represent that you are legally eligible to enter this Agreement. If you reside in a jurisdiction that restricts the ability to enter into agreements based on age, you agree to abide by such age limits, or you may not use STUCK Services. STUCK Services are not available to children (persons under the age of 18) or others who are not capable of legally entering into a binding contract. By using STUCK Services, you represent and warrant that you are at least 18 years old, or have the consent of a parent or legal guardian, and/or are otherwise capable of entering into a binding legal contract. When utilizing STUCK Services, you agree to comply with all applicable laws in the city, state, and country in which you reside.
You are solely responsible for maintaining the security and correctness of your registration information. You are fully responsible for all activity, liability and damage resulting from your failure to maintain password confidentiality. You agree to immediately notify STUCK of any unauthorized use of your password or any breach of security. You also agree that STUCK shall not be liable for any loss or damage arising from your failure to keep your password secure.
STUCK may place an immediate payment authorization to your credit or debit card in the amount of the Service request. The final charge to your credit card could vary from this initial estimate and authorization. You may cancel the service at any time, but there will be a non-refundable payment of $39 charged to your credit or debit card. Please note that you will be charged the full price of the service for any of the following reasons: Provider is on scene before you cancel; Provider determines that you have inaccurately stated the condition of your vehicle and/or service request; you are Gone On Arrival (GOA) and/or fail to cancel service.
By using the STUCK Services, you agree to the following:
You will only use the Service for lawful purposes.
You will not allow others to use your account.
You will not copy or distribute the Service or software or other content without written permission from the Company.
You will not sell STUCK Service to a third party.
You will keep your password or any other identification information secure and confidential.
You will provide STUCK with any proof of identity that we may reasonably request.
You agree that when requesting SMS responses, standard messaging charges do apply.
You will not use the STUCK service with an outdated or incompatible device.
STUCK reserves the right to immediately terminate the Service should you not comply with any of the foregoing.
