Article 1: This law lays down the rules governing the procurement, control, execution, regulation and regulation of public procurement in the Republic of Benin.
The provisions of this Law shall apply to the procedures for the execution, payment, control and regulation of all public works, supply, service and intellectual services contracts awarded by any Contracting Authority designated to the Article 2 of this Law.
Article 2: The provisions of this law apply to contracts awarded by:
1) The legal persons of public right that are:
• a) the State, the decentralized territorial collectivities;
• b) public institutions;
• (c) other bodies, agencies or offices set up by the State or decentralized territorial entities to satisfy needs of general interest and whose activity is financed mainly by the State or which benefit from the financial aid or the guarantee the State, a public authority or an association formed by these legal entities of public law.
2) Private legal entities that are:
• (a) private-law legal persons acting on behalf of the State, a decentralized territorial authority, a public-law body, a public institution and any company in which the State and legal entities referred to in paragraph 1ER of this article are majority shareholders or of an association formed by these legal entities governed by public law;
• b) semi-public companies, when these markets benefit from financial assistance and / or State guarantee or financial assistance and / or the guarantee of one of the legal entities governed by public law mentioned in paragraph 1; above.
3) Legal persons enjoying special or exclusive rights in the form of a convention. In this case, the act by which this right is granted provides that the entity concerned must, in the context of this activity, comply with the provisions of this law for public contracts it contracts with third parties.
4) Delegated contracting authorities for contracts awarded in connection with the performance of the duties assigned to them by a contracting authority.
