Aqiqah Law
Scholars disagree about the law. Some of them require it, but the majority say it is sunnah.
a. Parties that require Aqiqah, among others:
Shaykh Abdul 'Azim Al Badawi Rahimahullah in the book Al-Wajiiz states that 'aqiqah is an obligation on parents.
From Salman bin Amir adh-Dhabby Radhiyallahu'anhu, he said: "I once heard the Prophet sallallaahu 'alaihi wasallam say, "With a child there is 'aqiqah. So drain blood for him and remove distractions from him." (Sahih Ibn Majah no: 2562u Fathul Bari IX: 590 no 5472, 'Aunul Ma'bud VIII: 41 no: 2822u Tirmidhi III: 35 no:1551 and Nasa'i VII:164).
b. Those who declare Aqiqah is Sunnah, among others:
- Shaykh Utsaimin Rahimahullah: 'Aqiqah is a muakkadah sunnah (a highly recommended sunnah). For those who are unable to do so, this obligation (sunnah) falls from him.
- Imam Ahmad Rahimaullah said 'Aqiqah is the sunnah of the Prophet sallallaahu 'alaihi wa sallam. He has done it for Hasan and Husayn. His friends did too. And from Hasan bin Samurah radhiyallahu'anhu, the Messenger of Allah -peace and prayer of Allah be upon him- said,
"All children born are mortgaged with their 'aqiqah." (HR Abu Dawud, At Tirmidhi and An Nasa'i).
So it is not appropriate, if a father does not do 'aqiqah for his child. (Al Muntaqa Min Fatawa Shaykh Salih Fauzan (3/194)).
Aqiqah time.
It is sunnah on the seventh day of birth if missed then on the fourteenth day then if missed again then the twenty-first day.
From Burairah from the Prophet sallallaahu 'alaihi wasallam, he said, "The goat 'aqiqah is slaughtered on the seventh or 14th or 21st day." (Shahihul Jami'us Shaghir no: 4132 and Baihaqi IX: 303).
However, there are some scholars including Shaykh Salih Al Fauzan and Shaykh Ibn 'Utsaimin of the opinion that it is permissible to do 'aqiqah other than the time above without restrictions so that based on this opinion, parents who are not able to at that time can postpone it when they are able.
'Aqiqah is distributed to whom?
According to Shaykh Ibn Jibrin Rahimahullah: It is Sunnah to eat 1/3 of it, give 1/3 of it to his friends (friends of his parents) and give 1/3 of it to Muslims. But it is also permissible to invite friends and relatives to serve it or give it all to charity. (Aktsar min Alf Answer lil Mar'ah).
Is Aqiqah still held for Premature Fetuses?
According to Shaykh Ibn Uthaimin Rahimahullah: If the fetus is born after 4 months, the ruling is as if the baby lives or dies. Because if it has been perfect 4 months the spirit has been blown. If born after that, then it is bathed, shrouded, prayed and buried in Muslim cemeteries, named and di'aqiqahi.
If he was born before being breathed by the spirit (the womb is under four months old, ed) then according to Al-Lajnah ad Da'imah, there is no 'aqiqah for him even though he appears to be male or female.
