The procedure regulated in this royal decree concerns the extension of the provisions of a collective agreement in the course and conditions provided in Article 92.2 of the revised text of the Law of the Workers' Statute, approved by Royal Legislative Decree 1 / 1995 of 24 March.
With the effects provided in Article 82.3 of the revised text of the Law of the Workers' Statute, it may extend the provisions of a collective agreement in force higher than the company to a plurality of companies and workers or a sector or subsector field activity belonging to the same or similar functional area or economic and labor comparable characteristics, taking into account the activity where it will be applied and are not bound by collective agreement, whatever its scope, for damages caused to those of the impossibility subscribed in this field of a collective agreement under title III of the revised Statute Law Workers, due to the absence of parts authorized to do so.
In the case of no collective agreement can be extended scoped than enterprise application may be extended alternative, exceptionally, an enterprise agreement to a plurality of companies and workers or a sector or subsector activity similar economic and social conditions.
